COMMERCIAL GUARANTEE

Effective from: 1st September 2025

 

This voluntary commercial guarantee policy outlines the terms and conditions under which Nitro AG (“Nitro”) provides commercial guarantee coverage for: 

· Nitro snowboards

· Nitro boots

· Nitro bindings

 

1.     Application 

This commercial guarantee policy applies to products either purchased on nitrosnowboards.com or through an authorised dealer.

 

2.     Commercial Guarantee Coverage 

Nitro guarantees to the original purchaser that new and unused Nitro snowboards, bindings and boots are free from defects in materials and workmanship, under normal and intended use. 

This commercial guarantee is only valid for the original purchaser and is not transferable.

 

3.     Commercial Guarantee Period 

All Nitro snowboards, bindings and boots are covered by a commercial guarantee for a period of 2-years from the date of purchase, limited to production year 2021/2022 and after. All products produced prior to 2021/2022 are not covered by a commercial guarantee.

This does not affect your statutory rights under applicable consumer protection laws.

 

4.      Submitting and Processing a Claim
  • Purchased your goods on nitrosnowboards.com ? Then submit your claim directly via this form 
  • Purchased your goods from an authorized dealer? Then please first contact the dealer from where you bought your product. If you don’t receive a solution there, you can easily reach us at Nitro AG via our contact page. We will then forward your case to our partner in the country where you purchased your product and assist with the process.

Important: You must submit a valid proof of purchase. Without it, your claim may be denied.

 

5.     What Nitro does in the event of a defect

If, after inspection by Nitro or the retailer, your product is determined defective it will be either repaired or replaced at the discretion of Nitro or the retailer – depending on the type of defect and product availability.

.Repaired or replaced products are only covered for the remaining duration of the original commercial guarantee period.

 

 

6.     Return shipping costs of claims 

In the event of a valid commercial guarantee claim or a defect covered by statutory warranty rights, Nitro shall bear the reasonable costs of returning the goods, if they were purchased on nitrosnowboards.com . Nitro will provide the customer with a return shipping label from our logistics partner GLS.

Should the customer choose another shipping service provider without Nitro’s prior consent, Nitro shall only reimburse the costs up to the amount that would have been incurred using GLS.

 

Products purchased from an authorised dealer and distributor are subject to the dealers and distributors shipping terms.    

 

7.     Exclusions from Coverage 

The commercial guarantee does not cover damages caused by:

 

  • Misuse, abuse, neglect, or accidents
  • Normal wear and tear from riding
  • Improper mounting, adjustment, or installation of bindings
  • Use of solvents or thread locking adhesives on bindings or inserts
  • Use of non-Nitro hardware for binding mounting
  • Impact or abrasion with non-snow surfaces (chairlifts, rocks, rails, stairs, snowboard edges, etc.)
  • Any reason other than a defect in materials or workmanship
  • Boot damage caused by protruding elements or mechanisms on non-Nitro bindings

 

8.      Commercial Guarantee Conditions 

The commercial guarantee is void if there are any modifications or alterations of the original product.

 

9.      Limitation of Liability

This guarantee does not cover any incidental or consequential cost, losses or damages. 

This limitation does not affect your statutory rights under applicable consumer protection laws, nor does it apply in cases of damages caused intentionally or by gross negligence.

 

10.  Supplement to your statutory rights

This commercial guarantee does not affect your statutory right of withdrawal and statutory legal guarantee rights under applicable national laws relating to the sale of consumer goods.  These statutory rights are neither restricted nor replaced by this commercial guarantee.
